Implementation Plan for Visa Exemptions under Decree 221

Vietnam has taken a significant step forward in streamlining its visa policies by approving a detailed implementation plan for the Government’s Decree 221. This decree is designed to grant time-limited visa exemptions to foreign nationals who are considered special beneficiaries and are entitled to preferential treatment. The goal is to support Vietnam's socio-economic development by facilitating easier access for individuals who contribute to the country's growth.

The plan outlines specific roles, timelines, and responsibilities for all relevant agencies and units. This ensures that the implementation of the decree is carried out in a timely, comprehensive, coordinated, effective, and lawful manner. It emphasizes the importance of collaboration among different sectors to ensure consistency and efficiency in the process.

Coordination Among Key Agencies

One of the main objectives of the plan is to establish a close coordination mechanism among ministries, ministry-level agencies, government-affiliated bodies, local authorities, and other relevant organizations. This collaborative approach aims to create a unified front in implementing the provisions of Decree 221. By working together, these entities can address challenges more effectively and ensure that the policy is applied uniformly across the country.

The Ministry of Public Security plays a central role in this effort. It is responsible for coordinating with other ministries and agencies to disseminate the contents of Decree 221 through various channels. This includes the government’s official portal and other suitable methods that align with the legal framework and practical conditions. The aim is to raise awareness and ensure that all stakeholders—officials, civil servants, public employees, and those involved in implementation—have a consistent understanding of the decree.

Dissemination to the Business Community

In addition to internal communication, the Ministry of Foreign Affairs will collaborate with the Ministry of Public Security and other relevant agencies to spread awareness about Decree 221 among the business community, foreign investors, and eligible foreign nationals. This will be done through overseas media, international communication channels, and forums related to tourism and investment. Such efforts are crucial in ensuring that foreign entities understand the benefits and procedures associated with the visa exemptions.

Issuance of Special Visa Exemption Cards

The plan also requires that ministries, central-level agencies, and relevant organizations propose the issuance of special visa exemption cards to eligible foreign nationals. These cards must comply with the criteria outlined in Decree 221. Each agency or organization is expected to adhere to its specific functions, tasks, scope, and areas of operation when issuing these cards.

Furthermore, these entities are required to regularly review the status of foreign nationals holding valid special visa exemption cards. If an individual no longer wishes to request visa exemptions or no longer meets the criteria set out in the decree, they must notify the Ministry of Public Security in writing. This helps maintain the integrity of the system and ensures that only eligible individuals benefit from the policy.

Review and Amendment of Legal Documents

By March 1, 2026, all relevant ministries, central-level agencies, government agencies, and provincial and municipal People’s Committees must organize inspections and reviews of the legal documents related to the implementation of the decree. They are expected to propose amendments, supplements, replacements, or the issuance of new legal documents if necessary. This ensures that the policy remains up-to-date and aligned with current needs and circumstances.

Criteria for Research Institutes and Enterprises

Starting in 2026, the Ministry of Education and Training will take the lead in proposing criteria for identifying and listing research institutes, universities, and major universities. Similarly, the Ministry of Finance will be responsible for identifying and listing large enterprises authorized to invite foreign nationals under the special categories outlined in the decree.

The Ministry of Public Security will collect these proposals and submit them to the government for approval. It will have the authority to approve amendments or additions to the list within 30 days of receiving input from the Ministry of Education and Training and the Ministry of Finance.

Regular Reporting to the Prime Minister

Finally, all ministries, ministry-level agencies, government-affiliated bodies, municipal and provincial People’s Committees must report to the Prime Minister through the Ministry of Public Security on the progress of both the decree and the action plan. These reports are due by August 15 each year or as directed by the Prime Minister on an ad hoc basis. This ensures continuous oversight and accountability in the implementation process.
